			<content:encoded><![CDATA[<p>It is always very essential to be able to distinguish between <a href="http://criminal.laws.com/">criminal laws</a> and civil laws, and draw the lines between criminal versus civil law. This would help us understand issues as they happen around us, and would also enable us handle matters when we find ourselves in situations that need clarification for civil and <a href="http://criminal.laws.com/">criminal laws </a>. It is not true that only law graduates, lawyers or law enforcement agents that should know how to apply or interpret the laws in given situations, we should also be able to do some amount of this. In fact, that is why you may not be able to cite ignorance as a defense at law because the law presumes that even though you are not mandated to know the whole gamut of the law, you must know legal relevance of whatever you do as it applies to the law. That is, you must know how the laws apply to whatever you choose to do at whatever time and place, at least within the ambit of your own little world and activities.<br />
Criminal versus civil law as treated in this article only attempts to highlight some few areas of differences and similarities in the two types of laws in the society.</p>
<p>a. Filing a lawsuit: In a criminal case, the state or government brings action against a defendant in a law court, standing as the plaintiff and the injured party – because any criminal offense is deemed to be committed against the state or nation or government. But in civil cases, the lawsuit is filed by private individuals against another individual or state. The private individual is the plaintiff in any civil case but the government is the plaintiff in any criminal case, and the case is prosecuted by an officer of the state or government.</p>
<p>b. Punishment: In a criminal case, the defendant may be found guilty and punished by jailing or paying of some heavy fines or even put to death in extreme cases. But in civil case, the defendant is not jailed or sentenced to death but will only be required to pay fines as damages to the injured party.</p>
<p>c. Burden of proof: In a criminal case, the defendant or accused is presumed innocent until it can be proved beyond all reasonable doubts that he is guilty, and the burden of proof lies upon the state or the government. The state has to prove that this accused has committed a crime and run afoul of criminal statutes. The only exception is where the defendant claims insanity or duress and has to prove that. But in a civil case, the burden of proof is on the defendant to prove that he did not do what he is accused to have done.<br />
These are just few that will be treated in this article but it should be noted that there are exceptions to these above-listed notes on criminal versus civil law. You may not really know the exceptions but these will be proved by lawyers when they meet in court over any particular criminal versus civil law case.</p>

<p>•There are plenty of attorneys that specialize in defending people who are accused of crimes. Crimes range from misdemeanors to serious felony charges. If a person is accused of a crime, using an attorney will be necessary to defend them properly in a court of law. This is one of the only times when one is given a free attorney by the state if they can not afford one. Attorneys will help defend an individual from many different types of crimes. This might includes everything from robbery, murder charges and sex crimes. Charges that an attorney will be equipped to handle can also include drunk driving, fraud and theft charges.</p>
<p>•Attorneys that specialize in business and financial matters are called corporate attorneys. These specializations include administrative law, consumer law, debt collection, and state and federal taxes.  In some cases, an attorney that specializes in business and financial matters may also be the kind to turn to in cases of fraud. Many companies employ these corporate attorneys to battle any issues that come their way. Large corporations may have many corporate attorneys on stand by at all times, while small ones may just hire one if they need to.</p>
<p>•An attorney that many find themselves in need of is one that specializes in family matters. There are many reasons why a person might want to retain an attorney that specializes in that area. An impending divorce or custody battle  re the most common. No matter what kind of case an individual may be dealing with, an attorney will be dedicated to helping them through the process. Many divorce and child custody cases turn into ugly matters that can drag out for months or even years in a family court. A family attorney is especially necessary in a case like that. One will have their pick of attorneys that specialize in cases of that nature, so they will surely be able to find an attorney that will meet their demands and expectations. In addition to divorce and custody cases, attorneys specializing in family matters may also handle cases involving alimony, restraining orders, and any claims of domestic violence.</p>
<p>•Another attorney that many people find themselves in need of eventually are those who specialize specifically in trusts and wills. Many people are making sure that their assets are accounted for and their family taken care of in the event of their death. Attorney will help an individual review their assets and make sure that all legal and financial matter would be handled according to plan. Attorneys handle many cases like this. Younger people are making wills and not just the sick and elderly. Parents are likely to have wills made, even if they are on the younger side. An attorney will work to draw up the arrangement one wants.</p>
<p>The type of attorney one needs depends on the nature of the incident. Some, like traffic tickets are easy for an attorney to handle. Complicated cases like a murder charge will be much more difficult. Deciding on what type of  attorney to hire depends on what kind of attorney an individual needs, how much they can afford and how the relationship between the attorney and client is. <p>Getting into a reputable law school is no easy task. Although it seems that there will always of people out and breaking laws, the number of people applying to law school is staggering. This makes competition for spots in the top law schools even stiffer than it already was. Having a strong knowledge of laws in general is not enough to become a lawyer or get into law school. There are several steps that one should take if they really want to become a lawyer.</p>
<p>•Admission requirements for law school depend on what law school one is trying to go to. Some admission requirements are the same no matter where one attends. Getting an undergraduate bachelor&#8217;s degree is the first step. While one can technically get into law school no matter what they majored in while attending college, political science is a very popular major for future law students. Political science concentrates heavily on laws, politics and other issues one might face when entering the law field. Some colleges even have pre-law majors. After the undergraduate degree has been obtained it is time to take the Law School Admissions Test, also known as the LSAT.</p>
<p>•The scores that one gets on this test will be a big determining factor when applying for law schools. The LSAT test is a good test for measuring logic. That is why law schools use it. The LSAT takes roughly half a day to finish. While there are questions regarding various laws on the test, it is mostly designed to get an idea of an individual&#8217;s thinking pattern and thought process. The higher scores that one can achieve on the LSAT, the better chances one has of getting into the law school of their choice. While the LSAT is very important, there are other things one can do in order to improve their chances of getting into law school.</p>
<p>•While still an undergraduate, a person should try to get an internship with a law firm. Learning up close about laws from professionals gives one more hands on experience that can not be found in a class room. Extracurricular activities are also important. A great activity for people wishing to go to law school may want to join a debate team if their college has one. A lawyer will spend a good portion of their career debating: showing a law school that one is already skilled at it may improve one&#8217;s chances of getting into a good law school.</p>
<p>Not everyone knows what they want to do right away. Some people start out on one career path and end up in a completely different place then they thought they would. One does not have to go to law school immediately after they graduate from college. A time-out might even help an individual get into law school if they get a good job in between. Any positive work experience should go on the law school application.</p>

<p>•Earning a bachelor&#8217;s degree is the first step when trying to become a lawyer. Studying human rights laws in college is a good idea. No matter what kind of lawyer one wants to be, history or political science are popular majors for future lawyers. These topics offer studies in human rights and human rights laws. After getting a bachelor&#8217;s degree, an individual must take the Law School Admission Test. It is also known as the LSAT. This test is necessary when it comes to getting into a law school. The LSAT asks standard logic questions. Finding a law school to go to will depend somewhat the scores on the LSAT test. Since many individuals want to be human rights lawyers, it is a competitive field to work in. Because of this, attending a top law school is preferable.</p>
<p>•After entering law school, students should begin prepping themselves to enter the human rights field. A good way for a future lawyer to start is by volunteering at agencies that specialize in fighting for human rights laws. A good organization to volunteer with is Amnesty International. Amnesty International works to get political prisoners released from jail. Taking classes in law school that specializes on human rights are especially important. A human rights lawyer should know the basics of law in general, but they should be experts in human rights laws.</p>
<p>•When law school is finished, an individual is not officially a lawyer yet. One must take the state Bar exam. It is a difficult test that one should study for. The Bar exam covers everything that was taught in law school. individual cannot become a human rights lawyer, nor can they be licensed to practice any other types of law unless they pass the Bar exam. There are many study groups that exist for individuals studying to take the Bar exam. No matter what type of lawyer one wishes to be, they should know some aspects of different fields of law, not just human rights laws. Some states may require lawyers to take other courses in human rights as well as the Bar exam. Finding out this piece of information is important.</p>
<p>Even after graduating from law school, passing the state Bar exam, and coming away with a strong knowledge of human rights laws, finding a job can be difficult. Applying for jobs at law firms that specialize in handling human rights cases is a good idea for lawyers starting out. Networking with other lawyers and individuals in human rights organization can greatly help with the process of becoming a human rights lawyer.</p>
